DISTANCE SALES AGREEMENT
ARTICLE 1 – PARTIES

Hereinafter referred to as “Sylaatelier” within this agreement.
1.2 – BUYER
The customer whose billing or, if not available, delivery information is provided during the purchase on [.com] is defined as the “Buyer” in this agreement.
ARTICLE 2 – SUBJECT
This agreement determines the mutual rights and obligations of the Parties in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the product/service ordered electronically by the Buyer from [sylaatelier.com].
ARTICLE 3 – PRODUCT
The basic characteristics of the goods or services are available on Sylaatelier.com. These include the type, quantity, brand/model, color, number, sales price, payment method, and details at the time of order completion.
The listed prices are sales prices. These prices and promises are valid until updated or changed. Time-limited prices remain valid until the end of the stated period.
Unless otherwise stated in writing, shipping fees shall be paid by the Buyer and are non-refundable.
ARTICLE 4 – GENERAL PROVISIONS
4.1 The Buyer declares to have read and confirmed the product's basic features, sales price including all taxes, payment method, delivery details, and Seller information before confirming the contract electronically.
4.2 The product shall be delivered to the Buyer or the person/institution at the provided address within 30 days at the latest, depending on location.
4.3 If delivery is rejected by the recipient other than the Buyer, Sylaatelier cannot be held liable.
4.4 Sylaatelier is not liable for delays or failures in delivery due to shipping company-related issues.
4.5 Sylaatelier is responsible for ensuring the product is intact, complete, and matches the order.
4.6 Sylaatelier may provide an equivalent product of equal quality and price with the Buyer's approval, before fulfilling contractual obligations.
4.7 If it becomes impossible to fulfill the order, Sylaatelier will notify the Buyer within 3 days and offer a refund or a replacement of equal value and quality.
4.8 Product delivery is contingent on receipt of payment and submission of a signed copy of the contract. If payment fails or is canceled, delivery obligation ceases.
4.9 The Buyer agrees to the legal and financial responsibility for credit card use. If the card is used unlawfully by others after delivery and payment is reversed, the Buyer must return the product within 3 days. Shipping costs are borne by the Buyer. If the product is not returned, Sylaatelier is entitled to collect the amount due without prior notice.
4.10 In force majeure situations (e.g., severe weather or transport disruptions), Sylaatelier will inform the Buyer within 3 days. The Buyer may cancel the order, accept a replacement, or delay delivery. If canceled, the refund will be processed within 10 days. Credit card refunds will be sent to the bank within 7 days and may take 2–3 weeks to reflect in the Buyer’s account.
4.11 Points provided through promotions are valid for a single use and are non-refundable.
4.12 If any clause of the contract becomes invalid, the rest remain valid. Changes must be in writing and signed by both parties. Rights and obligations may not be transferred to third parties without prior written consent.
ARTICLE 5 – RIGHT OF WITHDRAWAL
The Buyer has the right to withdraw from the contract without providing any reason within 14 days of delivery.
To use the right of withdrawal, a written notification (registered mail, fax, or email) must be sent within 14 days and the product must not have been used beyond ordinary use.
If used:
a) The invoice (corporate returns require a return invoice).
b) Return form.
c) The product with its box, packaging, and standard accessories must be returned complete and undamaged.
Upon receipt of these, Sylaatelier will refund the Buyer within 10 days.
Domestic return shipping costs are borne by Sylaatelier and international returns by the Buyer. Shipping fees paid during purchase are not refundable.
If the invoice is not returned within 5 days of sending the product, the return will not be accepted, and the product will be shipped back to the Buyer.
ARTICLE 6 – NON-RETURNABLE PRODUCTS
According to Article 15 of the Distance Contracts Regulation, withdrawal rights do not apply to:
a) Goods or services with prices dependent on market fluctuations.
b) Personalized or custom-made items.
c) Perishable or soon-to-expire products.
ç) Items unfit for return due to health/hygiene once opened.
d) Mixed goods that cannot be separated by nature.
e) Opened books, digital content, and software.
f) Periodicals like newspapers or magazines (excluding subscriptions).
g) Scheduled leisure or transport services.
ğ) Digital services performed instantly.
h) Services started before withdrawal deadline with customer consent.
ı) Registered movables or drones.
i) Phones, smartwatches, tablets, and computers delivered to the Buyer.
j) Products sold via public auction.
k) Items installed by the seller/authorized service upon delivery.
ARTICLE 7 – COMPETENT COURT
The buyer may apply for complaints and objections to the consumer problems arbitration committee in the place where the consumer's residence is located or where the consumer transaction is made within the monetary limits determined by the Ministry of Industry and Trade in December each year, or if it is above these monetary limits, firstly to the mediation and then to the consumer court in case of failure to reach an agreement.
As of 2025, for disputes under 149,000 TL, Consumer Arbitration Committees are responsible. For disputes exceeding this value, applications must be made to the Consumer Courts or, where unavailable, to Civil Courts of First Instance acting as Consumer Courts.
These terms and conditions are governed by Turkish Law.
